JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-10-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Section 406 of the Indian Penal Code.

The prosecution case is that informant being Supervisor of Matrix Processing, New Delhi was allocated work of preparing Adhar Card. The Adhar Card was being prepared in the Samudayik Bhawan at Kargahar on 04.08.2014 when the petitioner came there for helping the informant in preparing Adhar Card since petitioner was also an employee of Matrix Processing, New Delhi but he took away laptop and bags. Subsequently the informant came to know that petitioner has been removed from the Matrix Processing, New Delhi. It is submitted by learned counsel for the petitioner that for the occurrence of 04.08.2014 the First Information Report was registered on 06.08.2014 which

Patna High Court Cr.Misc. No.41929 of 2015 (2) dt.12-10-2015 2/2 reached to the Court of learned Chief Judicial Magistrate on 08.08.2014. There is nothing on record to suggest that petitioner took the laptop.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Kargahar P.S. Case No. 209 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
