NILU AGRAWAL ORAL ORDER 01-04-2019 Heard the learned counsel for the petitioner and learned counsel appearing on behalf of the State. Petitioner is languishing in judicial custody since 30.08.2018 in connection with Gogri P.S.Case No.173 of 2018 for the offence alleged under Section 366A of the Indian Penal Code.
The prosecution case as lodged by the informant is that he had gone for treatment of his another child and in the meantime, the petitioner kidnapped his 15 years old daughter Sumitra Kumari for the purpose of marriage.
It has been submitted by the learned counsel for the petitioner that he is innocent, not committed any offence and the victim girl under Section 164 of the Cr.P.C. has revealed her age as 19 years and also revealed that she has gone out of her
Patna High Court CR. MISC. No.19152 of 2019(2) dt.01-04-2019 2/2 own sweet will with the petitioner. He submits that the petitioner is languishing in judicial custody since more than seven months and has been sufficiently punished for no fault. However, learned APP for the State opposes the prayer for bail stating therein that the victim is a minor as assessed by the medical board.
Considering the nature of allegations and the materials on record, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Gogri P.S.Case No.173 of 2018 to the satisfaction of Smt. Ankita Jaiswal, Judicial Magistrate, Ist Class, Khagaria, subject to the condition that one of the bailors would be a close relative of the petitioner having sufficient immovable property, who will file an affidavit stating his relationship with the petitioner.
