The petitioner seeks bail in a case instituted for the offences under Sections 121, 379, 414, 120B read with Section 34 of the Indian Penal Code, Sections 25(1-A), 25(1-B)A, 26, 35 of the Arms Act and 39 of the U.A.P. Act.

The prosecution case in short is that the accused persons were illegally involved in the arms trade and when the informant went for search, huge quantity of arms were recovered.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 9.10.2018 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. Charge-sheet has been

Patna High Court CR. MISC. No.22001 of 2019(2) dt.12-04-2019 2/2 submitted in the present case. The petitioner has falsely been implicated in the present case. The petitioner is not named in the F.I.R. The name of the petitioner has transpired on the basis of confessional statement of co-accused namely Manjar from whose possession, the arms have been recovered. There is no recovery of any arms from the possession of the petitioner. Other co-accused has been granted bail vide Annexure-2 to the present application.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R..

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger in connection with Mufassil P.S. Case No. 357 of 2018.
