Let the defects, if any, be removed within 15 days of the start of physical Court.

Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act.

Prosecution case is that country made liquor was recovered from the place of Bilo Ram and not from the physical possession or from the place of the petitioners. The villagers

Patna High Court CR. MISC. No.19969 of 2020(2) dt.02-07-2020 2/2 reported that the same was of the petitioners. Petitioners have got no criminal antecedent.

Considering the fact that there is no direct material against the petitioners, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000 (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Beldour P.S.Case No. 28 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
