The petitioner apprehends his arrest in Banka (Barahat) P.S. Case No. 102/2010, registered for the offences punishable under Sections 399, 402 of the Indian Penal Code, different Sections of the Arms Act and 3⁄4 of Explosive Substance Act.

Learned counsel for the petitioner submits that the petitioner is named in the FIR. Name of the petitioner figured in the case in the confessional statement of co-accused Santosh Kumar Mandal. Save and except the confession, there is no material to show the involvement of the petitioner. It appears that the petitioner has got criminal antecedent and he is accused in two other criminal cases. Considering the facts aforesaid, I am not inclined to

The petitioner, if so advised, may surrender before the court below within four weeks from the date of receipt/production of a copy of this order and pray for regular bail and his prayer shall be considered on its own merit without being prejudiced by this order.
