The petitioner seeks regular bail in connection with Gopalganj Town PS case no. 476 of 2018 registered for the offence punishable under Sections 414, 413, 420, 379, 467, 468, 371, 120(B) of Indian Penal Code. The allegation in the written report is that while the informant was on patrolling duty, he got information that a Scorpio vehicle was standing on the road and the people sitting therein were seen going to the A.T.M. one by one. The informant is said to have reached at the A.T.M. when the co-accused person namely Azad Alam started fleeing away. When he was apprehended, he disclosed that his colleagues were sitting the Scorpio vehicle and from the vehicle, the petitioner and other co-accused persons namely Ravi Bhushan Kumar Yadav and Shami Akhtar were apprehended and some money and several A.T.M. cards were also recovered.

No.72416 of 2018(2) dt.13-12-2018 2/2 The learned counsel for the petitioner has submitted that the petitioner is innocent and has been falsely implicated in the present case. It is further submitted that the petitioner is having a clean antecedent and is languishing in custody since 18.08.2018. Lastly, it is submitted that the similarly situated co-accused person namely Ravi Bhushan Yadav has already been granted bail vide order dated 12.10.2018 passed in Cr. Misc. no. 63458 of 2018.
Having regard to the facts and circumstances of the case as also considering the parity of the case of the petitioner with that of other co-accused persons who have already been granted bail, I deem it fit and proper to enlarge the abovenamed petitioner on regular bail. Accordingly, the abovenamed petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gopalganj in connection with Gopalganj Town PS case no. 476 of 2018.
