JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-06-2019 This is an application for grant of anticipatory bail in connection with Muffasil P.S. Case No.26 of 2017, disclosing offences under Sections 341, 323, 307, 379, 504, 34 of the Indian Penal Code.
Allegation against the petitioner and other accused persons is of assault to the informant, causing injury. Submission of the learned counsel for the petitioner is that there is general and omnibus allegation against all the petitioners and one of the co-accused having similar allegation has been granted anticipatory bail vide order dated 10.01.2019 passed in Criminal Misc. No. 78774 of 2018 by this Court. Heard learned A.P.P. also.
Having heard both sides, considering the above submission, this application is allowed. Let the petitioner,
Patna High Court CR. MISC. No.20106 of 2019(4) dt.19-06-2019 2/2 above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of Shri D. Singh, learned Judicial Magistrate, 1st Class, Katihar, in connection with Muffasil P.S. Case No.26 of 2017, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
