JUSTICE MIHIR KUMAR JHA ORAL JUDGMENT 29-01-2015 Heard learned counsel for the parties as with regard to the following reliefs, prayed in this writ application:- "For direction to the concerned respondents to extend the reasonable date for filing the application for appointment of the distributor of the L.P.G. Gas only in respect of the Kasba(Purnea) location which was placed at serial no. 36 at the said Advertisement dated 19.01.2009. For direction to the concerned respondents that after extension of reasonable date for filing the application for appointment of the distributor of the L.P.G. only in respect of the Kasba (Purnea) location, and after receiving the said wanting application, proceed together for selection of the

As would be evident from the prayer of the petitioner in this writ application that he wants extension of date of filing of the application which was fixed under an advertisement dated 19.01.2009, for allotment of LPG Distributorship. A period of more than six years have already expired and now this Court would find it difficult to even issue any direction for extension of date of filing of application specially when Mr. Sanjay Singh, learned counsel for the Bharat Petroleum Corporation Limited (B.P.C.L) submits that the selection as per advertisement dated 19.01.2009, has already been concluded way back.
The only submission of learned counsel for the petitioner that since the location in question at Kasba (Purnea) which was also covered by the advertisement dated 19.01.2009, no one has been selected and allotted the LPG Dealership in question also cannot be ground for grant of relief prayed herein as the same would mean
Patna High Court CWJC No.8489 of 2009 (2) dt.29-01-2015 that this Court will have to direct the authorities to give effect to the aforesaid advertisement dated 19.01.2009. Thus all that in the changed circumstances can be said by this Court is that if and when B.P.C.L. shall feel the necessity of giving LPG Dealership for Kasba in the district of Purnea and would issue an advertisement, for this purpose the petitioner may also apply with others and in that event the case of the petitioner can be considered with others in accordance with law. With the aforementioned observations and direction, this application is disposed of.
