The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 452, 323, 354, 354(A), 354(B), 379, 386, 506, 504 and 427 of the Indian Penal Code.
A person died in a road accident. The infuriated mob entered into the house of the informant alleging that the husband of the informant had caused the accident and death. There is allegation that the mob ransacked the house-hold committed mischief by damaging the articles and theft articles of Rs.20,00,000/- (rupees twenty lacs). The petitioner was identified in the mob.
Considering the general and omnibus nature of
Patna High Court Cr.Misc. No.22139 of 2017 (2) dt.18-05-2017 2/2 allegation, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 4th Additional Chief Judicial Magistrate, Katihar/successor Court in connection with Kadwa Police Station Case No. 89 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
