The petitioner is languishing in custody since 02.08.2018 in connection with Samastipur Muffasil P.S. Case No.465 of 2018 registered for the offences punishable under Sections 120B, 420, 467, 471 of the Indian Penal Code. Prosecution case as per the FIR is that the petitioner got selected as Constable in pursuance to Advertisement No.1 of 2017 but during enquiry, it was found that the petitioner signature does not tally with the signature made on the admit card and the other documents. It was informed that someone impersonated the petitioner and appeared at the examination. It is submitted by learned counsel for the petitioner

Patna High Court Cr.Misc. No.72803 of 2018(3) dt.23-01-2019 2/2 that only on the basis of suspicion, petitioner has been remanded to custody and in similarly situated case, one Rinku Kumar has already been granted bail by a coordinate Bench of this Court vide order dated 08.10.2018 passed in Cr. Misc. No.61678 of 2018.

Learned APP, however, submits that the allegation is specific against the petitioner of having committed forgery and cheating.

Considering the fact that petitioner is no longer in the job and the fact that the other co-accused has already been granted bail by a coordinate Bench of this Court coupled with the statement made in paragraph 3 that the petitioner is not having criminal antecedent, let the above named petitioner be enlarged on bail on furnishing bail bond of Rs.10000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-V, Samastipur in connection with Samastipur Muffasil P.S.
