The petitioner apprehends her arrest in connection with Mali P.S. Case No. 37 of 2016, registered under Sections 47 and 54 of the Bihar Excise (Amendment) Act, 2016. The accusation is of recovery of 2452 pouches contained in 16 bags of country made liquor from the Scorpio bearing Registration No. BR-24P-0675, which was being driven by Sachitanand Kumar, in which, Raju Kumar Singh, son of petitioner, was found sitting.
Learned counsel for the petitioner submits that petitioner is lady and vehicle in question was purchased in the name of this petitioner but she had no knowledge about carrying
Patna High Court Cr.Misc. No.5855 of 2017 (2) dt.20-03-2017 of illicit liquor through the Scorpio by her son. It is further submitted that petitioner, who is lady, has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of her arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the J.M. Ist Class, Aurangabad, in connection with Mali P.S. Case No. 37 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
