JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-03-2024 This is an application for quashing of F.I.R., vide Mufassil P.S. Case No. 692 of 2022 dated 19.12.2022 for the offence punishable under Sections 341, 323, 498-A, 307, 504, 34 of the Indian Penal Code and Section 3 / 4 of the Dowry Prohibition Act.
2. At the outset, by way of filing supplementary affidavit, learned counsel for the petitioner submits that both parties have settled their dispute and presently, opposite party no. 2 is staying with her in-laws members. To this effect, a compromise petition dated 09.06.2023 has been annexed with this supplementary affidavit, as "Annexure - 1".
3. In view of aforesaid facts and circumstances, this
Patna High Court CR. MISC. No.24229 of 2023(3) dt.18-03-2024 2/2 petition is disposed of with liberty to the petitioner to move before the learned Court below on the basis of compromise petition and if the compromise petition is supported by the O.P. No. 2, the prosecution of the petitioner shall be dropped and if the compromise petition is not supported by the O.P. No.2, then the learned Court below shall pass appropriate order in accordance with law.
4. With above observation and direction, this petition stands disposed of.
