Petitioner seeks bail in connection with Phulwaria P.S. Case No. 182 of 2020 registered under Sections 302/34 of the Indian Penal Code.

The Court, having considered the heinous nature of allegation of assaulting the informant's sister on her head by 'Dabiya' and the same being corroborated by eye-witness in the investigation as also the injury report, had rejected the petitioner's prayer for bail under order dated 02.08.2021 passed in Cr. Misc. No. 8967 of 2021.

The prayer has now been renewed by the instant proceedings. The petitioner is in custody now since 08.08.2020. Under earlier order passed in this case, report was called

Patna High Court CR. MISC. No.21556 of 2023(4) dt.21-06-2023 2/2 for from the trial court.

The report is to the effect that four witnesses have already been examined and for examination of the remaining witnesses non-bailable warrant has been issued.

Since the trial is under progress, for the present, this Court does not consider it appropriate to take a different view. This Court, for the present, is not inclined to allow petitioner's prayer for bail. The same is rejected. The application for bail is thus dismissed.
