The petitioner, namely, Kailash Mandal who apprehends his arrest in Jagdishpur(Goradih) P.S. Case No.144 of 2014 under Sections 341, 323, 354, 504 and 506 of the Indian Penal Code.

It appears that F.I.R. was lodged by the informant alleging that the petitioner tried to molest the informant and assaulted her.

The learned counsel for the petitioner submitted that the petitioner is aged about 65 years and he is the Bhaisur of the informant i.e. the informant is the Bhabho of the petitioner and there is land dispute between the parties. 107 Cr.P.C. proceeding

Patna High Court Cr.Misc. No.41609 of 2015 (2) dt.08-10-2015 is going on and there has already been compromise between the parties. The compromise application has also been annexed with this anticipatory bail application.

Considering the above facts, I direct the petitioner named above to surrender before the court below within six weeks from today and on his so surrendering, the court below is directed to release the petitioner on bail on furnishing bail bond of Rs.10,000/-(Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in connection with Jagdishpur(Goradih) P.S. Case No.144 of 2014 subject to condition laid down under Section 438(2) of Cr.P.C..
