====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SINGH CHANDEL ORAL ORDER 21-04-2025 Heard learned counsel for the petitioner as well as counsel for the respondent-State.

2. It is submitted by the counsel for the petitioner that

Patna High Court CWJC No.5812 of 2025(2) dt.21-04-2025 2/3 petitioner has retired from his services on 31.01.2011, he is getting the pensionary benefit as per the grade pay fixed under the 5th pay scale. But, he is entitled to get the pensionary benefit according to the 7th pay scale. Learned counsel further submits that raising all his grievances he already made his representation before the respondent no. 3 vide Annexure- P/4 but, no decision has been taken by the concerned respondent.

3. Counsel for the respondent-State submits that in Annexure - P/4 there is no mentioning of the date and there is also no receiving mentioned in the said Annexure - P/4. Therefore, he submit that this petition may be disposed of, directing the petitioner to make a fresh representation before the respondent no. 3 raising all his grounds which he raised in this writ petition and in turn, the concerned respondent may also be directed to consider and decide the same within any specific period fixed by this Court.

On the basis of above submission made by the counsel for the respondent which is not opposed by the counsel for the petitioner, this writ petition is disposed of giving liberty to the petitioner to make a detailed representation raising all grounds which he raised in this writ petition before the concerned respondent no. 3. It will done within four weeks from

Patna High Court CWJC No.5812 of 2025(2) dt.21-04-2025 3/3 today and, in turn, on submission of such concerned respondent is also directed to consider and decide and pass a reasoned order in accordance with relevant rules and laws as early as possible probably within six months from submission of such representation.
