The petitioners apprehends their arrest in Gogri (Poura) P.S. Case No. 247 of 2014 instituted for the offence under sections 147, 148, 149, 341, 323, 379, 307, 504, 506 of the Indian Penal Code.

It is alleged in the written report that petitioner no.4 assaulted on head with lathi of informant, causing head injury. It has further been submitted that petitioner nos. 1 and 3 assaulted on the head of Gautam Kumar, causing bleeding injury. The injury report has been filed (Annexure-2) wherein the doctor has found simple injury on right middle part of skull of

Patna High Court Cr.Misc. No.9315 of 2017 (2) dt.06-03-2017 2/2 both the injured, caused by hard blunt substance. From the injury report itself, it is apparent that there is no repetition of blows. There is general and omnibus allegation against the petitioner nos. 2 and 5.

Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioners is allowed. In the event of surrender/arrest of the petitioners named above, within six weeks from today, in connection with Gogri (Poura) P.S. Case No. 247 of 2014,they shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria, subject to the conditions as laid down under Section 438(2) Cr.P.C.
