JUSTICE SANDEEP KUMAR ORAL ORDER 22-05-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner seeks regular bail in connection with Barachatti P.S. Case No. 66 of 2022, registered for the offence punishable under Sections 8(b), 18 and 29 of the N.D.P.S. Act. Learned counsel for the petitioner submits that the petitioner is innocent and falsely been implicated in this case on mere suspicion. He further submits that petitioner was neither seen at the place of occurrence nor the land over which opium plants were cultivated belongs to him. Similarly situated coaccused namely Birendra Singh Bhokta @ Birendra Singh Bhogta and Rajulal Keshri have been granted anticipatory bail by a co-ordinate Bench of this Court vide order dated 15.02.2023 passed in Cr. Misc. No. 53273 of 2022. Petitioner is

Learned APP has vehemently opposed the prayer for bail.

Considering the nature of allegation levelled against the petitioner, his period of custody, this application is allowed. Let the petitioner, above named, be released on bail, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court of Session Judge-cum-Special Judge, N.D.P.S. Act, Gaya in connection with Barachatti P.S. Case No. 66 of 2022.
