The petitioner is languishing in custody for the offences punishable under Sections 341, 323, 354(B), 290/34 of the Indian Penal Code and Section 37(a) (c) of the Bihar Prohibition of Liquor and Excise Act, 2016.
Allegation is that the petitioner entered into the house of the informant after consuming wine and attempted to outrage her modesty.
Submission is that false case has been lodged because at the instance of the petitioner's brother, liquor was recovered from the house of the informant by the police. Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of
Patna High Court CR. MISC. No.20033 of 2019(2) dt.10-04-2019 2/2 Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with Special Case No.111 of 2019 arising out of Bausi P.S. Case No.14 of 2019 with following conditions :
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court below.
(b) The petitioner shall fully cooperate with the investigation / trial of the case, failing which the Court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) sanjeev/- U T
