The petitioner seeks bail in a case instituted under Sections 467, 468, 471, 420, 120(B)/34 of the Indian Penal Code. The prosecution story, in brief, is that in view of the order of the Hon'ble Court passed in C.W.J.C. No. 15459 of 2014, the educational certificates of the petitioner and other coaccused were verified, wherein, it has been detected that the petitioner and other co-accused have got themselves appointed to the post of teacher on the basis of certificate of fake institution. It has been submitted on behalf of the petitioner that the petitioner is in custody since 07.08.2016. The petitioner has got no criminal antecedent. There is no allegation of tampering of
Patna High Court Cr.Misc. No.44299 of 2016 (3) dt.17-10-2016 2/2 witnesses alleged against the petitioner. The petitioner has been made accused due to mistake of fact. The date on which, the certificate was issued, it was valid. Subsequently, in the year 2011, the said certificate was derecognized. The other co-accused have been granted bail vide Cr. Misc. No. 36421 of 2016. On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria, in connection with Mansi P.S. Case No. 87 of 2016.
