2. The petitioner seeks bail in connection with NDPS Case No. 16 of 2025 arising out of Udwantnagar P.S. Case No. 38 of 2025 instituted for the offences under Sections 20(B)(ii) (c), 25, 27A, 29 of the N.D.P.S. Act.
3. Prosecution case, in short, is that total 30.500 Kg of ganja has been recovered in this case.
4. Earlier, vide order dated 30.06.2025 passed in Cr. Misc. No. 40883 of 2025, the prayer of the petitioner for grant of regular bail was rejected by this Court considering the recovery being above the commercial quantity and the petitioner being a party to the criminal conspiracy.

5. Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in the present case. The name of the petitioner has been disclosed by the co-accused Ankit Raj. The alleged recovery of Ganja has been made from the vehicle. The petitioner is neither owner nor driver of the said vehicle. The petitioner has not been apprehended on the spot. Learned counsel for the petitioner submits that general and omnibus allegation has been made against the petitioner. No specific overt act is alleged against the petitioner. He further submitted that no specific role has been attributed towards the petitioner with respect to the alleged recovery of Ganja. The alleged car has been booked by co-accused Ankit Raj from the Raj Tour and Travel, Saran, Chapra.
Learned counsel further submitted that there are four charge-sheeted witnesses and out of them, three have been examined which is evident from the report sent by learned court below. It has been submitted on behalf of the petitioner that the petitioner is in custody since 23.01.2025 and has no criminal antecedent. Similarly situated co-accused person has already been granted bail by this Court vide order dated 13.01.2026 passed in Cr. Misc. No. 85056 of 2025.
6. Learned A.P.P. for the State has vehemently
Patna High Court CR. MISC. No.21250 of 2026(3) dt.01-05-2026 3/3 opposed the prayer for grant of bail to the petitioner.
7. Considering the aforesaid facts and circumstances of the case, claim based on parity as also the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.
8. Let the petitioner be released on bail on furnishing bail bonds of Rs. 15,000/- (Rupees Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with NDPS Case No. 16 of 2025 arising out of Udwantnagar P.S. Case No. 38 of 2025, subject to the following conditions:
(I) One of the bailors shall be the petitioner's own or a close family member.
(II) The petitioner shall appear on each and every date fixed during the trial and shall not remain absent on two consecutive dates without sufficient cause.
In case of violation of any of the aforesaid conditions, the Trial Court shall be at liberty to cancel the bail bonds of the petitioner.
