JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but the impugned order goes to show that name of petitioner surfaced in this case in course of investigation and after that, he was arrested and confessed his guilt disclosing his involvement in the present case. Petitioner does have criminal antecedent of near about five cases.

Submission on behalf of the petitioner is that the name of petitioner came in this case in confessional statement of co-accused Sarwesh Kumar but the aforesaid co-accused Sarwesh Kumar has already been granted privilege of bail by a co-ordinate Bench of this Court.

Patna High Court Cr.Misc. No.37244 of 2016 (2) dt.06-09-2016 2/2 Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional District Judge VII, Aurangabad in connection with Madanpur P.S.Case No. 112 of 2015.
