2. Learned Senior Counsel for the petitioner submits that the Circle Officer, Musahari, Muzaffarpur, is under contempt in this case as he has not complied the order dated 21.08.2023 passed in CWJC No.2146 of 2023 by this Hon'ble Court.

3. Learned Counsel for the State, on the other hand,

Patna High Court MJC No.1027 of 2024(11) dt.25-07-2025 2/3 submits that show-cause has been filed and vide Annexure-A of the show-cause it becomes crystal clear that the Circle Officer, Musahari, Muzaffarpur, in compliance of this Hon'ble Court's order dated 21.08.2023 passed in CWJC No.2146 of 2023 has passed order and, therefore, he submits that the order of this Court has been fully complied.

4. Learned Senior Counsel submits that it is true that the said order has been complied, but in the grab of passing the said order the Circle Officer has dared to flowed the order of this Court and in spite of fixation of the rent of Belagan Mauja he preferred revision.

After hearing the argument, it transpires to this Court that under the contempt jurisdiction, particularly, hearing the civil contempt the definition of civil contempt as laid down in Section 2(b) of the Contempt of Court's Act, 1971 has to be looked into. It transpires to this Court that the order was to comply the order dated 17.04.2023 passed by Deputy Collector, Land Reforms, Muzaffarpur and not beyond that. This Court is of the firm view that the Circle Officer, Musahari, Muzaffarpur, is not in contempt. However, the liberty is hereby available to the petitioner by way of challenging the consequential events before the appropriate forum.

6. Accordingly, the M.J.C. application stands dismissed.
