For the Petitioner/s : Mr. Shakil Ahmad Khan For the Opposite Party/s : Mr. Sri Gauri Shankar Gupta ====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 07-12-2016 Heard Sri Sanjay Singh, learned counsel, who was assisted by Sri Shakil Ahmad Khan, learned counsel for the petitioner and Sri Gauri Shankar Gupta, learned Additional Public Prosecutor .
This is second attempt for grant of bail. Recently, vide order dated 11.4.2016 passed in Cr. Misc. No. 6919 of 2016 prayer for bail of the petitioner was rejected on merit . Sri Sanjay Singh, learned counsel for the petitioner tried to persuade the court that there is no specific material against the petitioner and he has been made accused only on confession. However the Court is of the opinion that once on merit prayer for bail was rejected there is no point to examine the case again on merit. He accepts that no substantial change has
Patna High Court Cr.Misc. No.52688 of 2016 (2) dt.07-12-2016 2/2 taken place save and except the fact that now the case has been committed to the court of Sessions.
In view of the fact that on merit prayer for bail was earlier rejected, there is no reason to review my earlier order. Prayer for bail again stands rejected.
It was submitted that case has been committed to the court of Sessions and charge has already been framed and petitioner is in custody since 19.12.2015 as such it is desirable to observe that the learned trial court may take appropriate steps so that the case may come to its logical end without unnecessary delay.
