JUSTICE ARVIND SRIVASTAVA ORAL ORDER 04-04-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

This is a petition for grant of regular bail in a case registered for offences punishable under Sections 302/34 of the Indian Penal Code.

Allegation upon the petitioner is of burning the grand son of the informant alive by pouring kerosene oil on him. It has been submitted by the learned counsel for the petitioner that he is innocent and has been falsely implicated in this case. It has also been submitted that F.I.R. has been instituted after one month delay of the occurrence. Petitioner is not named in the F.I.R. Victim in his statement before death, narrated the story,

Patna High Court Cr.Misc. No.5258 of 2017 (3) dt.04-04-2017 2/2 however he did not name this petitioner. Petitioner is in custody since 19.05.2014.

It has been submitted that named accused Anil Singh @ Anil Singh Yadav has been granted the privilege of bail by a Co-ordinate Bench of the Court in Cr. Misc. No. 33771 of 2016 dated 22.10.2016.

Considering the facts and circumstances and the fact that named accused has been granted bail, let the above named petitioner, Laxman Singh @ Lachuman Singh @ Laxman Yadav is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas at Sasaram in connection with Shiv Sagar (Baddi) P. S. Case No. 109 of 2014.
