JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-399, 402, 412 of the Indian Penal Code and under Sections-25(i-B)A/26/35 of the Arms Act.

Petitioner is said to have been caught along with others when the petitioner and others were assembled to make preparation for committing dacoity but according to prosecution case itself, nothing was recovered from conscious possession of the petitioner and having more or less similar allegation, some coaccused have already been granted privilege of bail by different benches of this court.

Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten

Patna High Court Cr.Misc. No.46479 of 2016 (2) dt.24-10-2016 2/2 thousand) with two sureties of the like amount each in connection with Tatarpur P.S. Case No. 14 of 2016 corresponding to Sessions Trial No. 432 of 2016 to the satisfaction of learned Additional Sessions Judge-IV, Bhagalpur.
