Md. Ataur Rahman, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 24-06-2023 Heard Mr. Sanjay Kumar Jha, learned counsel appearing on behalf of the petitioner and Md. Ataur Rahman, learned APP appearing on behalf of the State.

2. The petitioner apprehends his arrest in connection with Ganga Bridge P.S. Case No. 130 of 2021 registered under Sections 420, 467, 471, 120B and 34 of the Indian Penal Code.

3. As per the allegation made in the F.I.R., petitioner including other co-accused named in the F.I.R. have prepared forged document to grab the land of the informant by hatching a conspiracy with common intention.

4. Learned counsel appearing on behalf of the petitioner submits that the allegation against the petitioner is that he has identified the purchaser, while the agreement of sale was entered into between one Vijay Prasad Singh and Suman

5. Learned APP appearing on behalf of the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.

6. Having considered the nature of allegation made against the petitioner in the F.I.R, the petitioner has only identified the purchaser and the petitioner is not beneficiary of the said agreement. In above view of the matter, the petitioner has made out a, prima facie, case to be released on anticipatory bail.

7. Court below is directed to release the petitioner on anticipatory bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Vaishali, Hajipur in connection with Ganga Bridge P.S. Case No. 130 of 2021, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
