Petitioner no.1 being husband of the informant and petitioner no.2 being the second wife of petitioner no.1 are apprehending arrest in a case registered for the offences punishable under sections 498A, 341, 323, 504, 506 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act. Basic accusation is of torture for non-fulfillment of dowry demand.
It is submitted by learned counsel for the petitioners that petitioner no.1 admits his marriage with the informant and the informant and the petitioners have resolved the issue and filed a petition to that effect before the learned court below, which has been brought on record by way of supplementary

The aforesaid contention of learned counsel for the petitioners has not been disputed by learned counsel for the informant In view of the above facts it is a case for consideration of prayer for regular bail.
Let the learned Court below consider the prayer for regular bail of the petitioners, if the petitioners surrender within a period of six weeks in connection with Kadwa (Balia Belon) P.S. Case No.82/2015, pending before the learned CJM, Katihar.
With the above observation, this application is, accordingly, disposed off.
