Petitioners have filed this modification petition for extension of time to surrender before the Sub divisional Judicial Magistrate, Nalanda at Biharsharif in connection with Noorsarai P. S. case no. 151/2016 as they were granted privilege of pre-arrest bail vide order dated 22.12.2016 passed in Cr. Misc.no.45179/2016 with condition to surrender before the concerned court within four weeks from the date of receipt of the aforesaid order. Submission on behalf of the petitioners is that the concerned advocate's clerk did not give any information regarding the aforesaid order dated 22.12.2016 passed in Cr. Misc.no.45179/2016 that was the reason, petitioners could not surrender before the concerned court in

Patna High Court Cr.Misc. No.17461 of 2017 (2) dt.26-04-2017 time.

In view of the aforesaid submissions, this modification petition stands allowed. Accordingly, petitioners are permitted to surrender before the above stated court within four weeks from the date of receipt/ production of a copy of this order to the concerned court. The order dated 22.12.2016 passed in Cr. Misc.no.45179/2016 stands modified to the above stated extent.
