Counter affidavit has been filed on behalf of the State pursuant to order dated 24.11.2016.
After hearing learned counsel for the parties, the only prayer to which the petitioner restricts himself is for a direction to the District Co-operative Officer, Patna to get the revised voter list prepared and on the basis of which election be held by the State Election Authority.
The Court is not inclined to pass any positive order and would only grant liberty that all such matters or dispute which the petitioner has raised in the present writ petition, may be brought to the notice of the Registrar, Co-operative Societies, Bihar by filing an appropriate application under Section 48 of the Bihar Co-operative Societies Act, 1935, which shall be looked into and decided, in accordance with law, expeditiously and follow-up/consequential action, as may be required, be also taken.
