JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-12-2018 Petitioner prays for bail in connection with Banka P.S. Case No. 407 of 2018 registered for the offences punishable under Sections 147, 148, 149, 385, 427 and 504 of the Indian Penal Code.

Allegation against the petitioner is of demanding extortion from the informant, who is Manager of Mahadeo Enclave and further there is also allegation of threatening the informant against the petitioner.

Submission of learned counsel for the petitioner is that the informant is himself running a gang and he has implicated innocent persons and earlier also a case has been lodged against the petitioner in which he has been granted bail and so far present case is concerned, co-accused persons have been granted bail by a co-ordinate Bench of this Court vide

Patna High Court Cr.Misc. No.69124 of 2018(2) dt.03-12-2018 2/2 order dated 25.9.2018 in Cr.Misc.No. 48774 of 2018 and he is in custody since 2.9.2018.

Heard learned APP also.

Having heard both sides and in the facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Banka, in connection with Banka P.S.Case No. 407 of 2018, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
