====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ------------- 15-10-2015 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends her arrest in connection with Chapra Nagar Town P.S. Case No.106 of 2015 registered under Sections 409 and 420 of the Indian Penal Code. The accusation is that Nawal Kishore Giri being the President of PACS, Bajahiya, and Rekha Devi (petitioner), had to receive the paddy from the farmers, for which cheque of Rs.10,05,370.16/- was handed over to them but the paddy has not been sent to the Bihar State Food Corporation. As such, the aforesaid amount could not be credited to the Bihar State Cooperative Bank Limited.

Patna High Court Cr.Misc. No.43530 of 2015 (2) dt.15-10-2015 2/2 Learned counsel appearing on behalf of the petitioner submits that Rekha Devi is the daughter-in-law of Nawal Kishore Giri, who is said to be President of PACS, and died in the year 2014. While the petitioner has no concern with the PACS but being the daughter-in-law of aforesaid Nawal Kishore Giri, she has falsely been implicated in this case.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of her arrest or surrender by her within six weeks from today, be enlarged on bail on her furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saran at Chapra, in connection with Chapra Town P.S. Case No.106 of 2015, subject to the conditions laid down under Section 438(2) Cr.P.C.
