JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 364 A of the Indian Penal Code.

Petitioner is not named in the first information report but in course of investigation, victim stated that after kidnapping he was kept in the house of this petitioner for a certain period. Coaccused, Raju Choudhary also named the petitioner in his confessional statement. No doubt, the present occurrence is said to have taken place in the year 2004 and petitioner could be remanded in this case after near about eleven years but submission

Patna High Court Cr.Misc. No.38564 of 2016 (3) dt.18-11-2016 2/2 on behalf of the petitioner is that petitioner was not aware about the institution of the present case and having more or less similar allegation, several co-accused have already been granted privilege of bail by different Benches of this court. Para-3 of the petition goes to show that petitioner does not have any criminal antecedent and moreover, the victims were recovered from the house of other co-accused.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-IX, Rohtas, Sasaram in connection with Sessions Trial No. 691 of 2015 arising out of Dehri (Town) P.S. Case No. 166 of 2004, subject to condition that he shall attend the trial court on each and every date in person for the period of nine months or till conclusion of his trial whichever is earlier and if he fails to do so on two consecutive dates without any genuine cause, the learned trial court shall be at liberty to cancel the bail bonds of the petitioner.
