The petitioner is in custody in connection with Kotwali (Tilkamanjhi) P.S. Case No. 908 of 2017 for the offences under Sections 379 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 04.08.2018. He further submits that petitioner was not named in the F.I.R. and his name surfaced on confessional statement of co-accused Dharmendra Kumar Singh and the charge sheet has been submitted in this case on 28.09.2018.

Considering the fact that petitioner has remained in custody for more than seven months, the Court is inclined to

Case No. 908 of 2017.
