1. Heard learned Senior Counsel for the petitioner and learned A.P.P. for the State.

2. The present Cr. Misc. Application has been filed for cancellation of anticipatory bail granted to the opposite party no.2 by the learned Additional Sessions Judge, III (I/C), Katihar vide order dated 05.12.2023 passed in A.B.P. No.1462 of 2023.

3. Learned Senior Counsel for the petitioner submits that this case may be disposed of with liberty to the petitioner for filing of appropriate petition including the cancellation of bail before the learned Trial Court, in case, the opposite party no.2 would try to threaten or tamper with the evidence.

4. Learned A.P.P. for the State has no objection to this
