JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-12-2018 The petitioner seeks regular bail in connection with Katihar Town P.S. Case No. 552 of 2018, registered for offences punishable under Sections 344, 365, 372 and 34 of the Indian Penal Code.

Allegation against the petitioner is of kidnapping the minor daughter of the informant.

Submission of learned counsel for the petitioner is that the girl has been recovered after 4 years and though her statement under Section 161 Cr.P.C. was recorded by the police, but neither the statement of girl under Section 164 Cr.P.C. has been recorded nor she has medically examined. Further submission is that the statement of girl also shows that she had herself left her house and she was living in the house of the petitioner, who used to engage her in prostitution. Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar, in connection with Katihar Town P.S. Case No. 552 of 2018.
