Heard the parties.

The petitioner is languishing in custody for the offence punishable under Section 392 of the Indian Penal Code. The F.I.R. of the occurrence of robbery is against unknown. Petitioner has got no criminal antecedent. Petitioner is in custody since 02.01.2020. Investigation of the case is already complete.

Submission is that neither the petitioner was put on T.I. parade during the investigation of the case nor any incriminating article has been recovered from his possession. Only material is confessional statement of co-accused before the police which cannot be used as evidence in view of bar under

Patna High Court CR. MISC. No.21662 of 2020(3) dt.03-09-2020 2/2 Sections 24 and 25 of the Evidence Act.

Considering the submission aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Belaganj P.S. Case No. 425 of 2019, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
