2. Learned counsel for the petitioner submits that the prayer for bail of the petitioners has earlier been rejected vide order dated 07.11.2023 passed in Criminal Miscellaneous No. 70865/2023 granting liberty to the petitioners to renew their prayer for bail after framing of charge.
3. Learned counsel for the petitioners further submits that the charge has already been framed in this case on 16.02.2024.
4. Learned counsel for the State opposes the prayer
Patna High Court CR. MISC. No.23947 of 2024(3) dt.10-05-2024 2/2 for bail and submits that on earlier occasion, a report with regard to present status of the case has been called for.
5. Upon perusal of the status report, it appears that after framing of charge, no single witness has been examined.
6. In this view of the matter, let the petitioners above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Second, Aurangabad, in connection with Aurangabad Excise P.S. Case No. 607/2023, subject to the conditions as laid down under Section 437(3) of the Code of Criminal Procedure. (Dr. Anshuman, J) Ashwini/- U T
