JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 07-05-2015 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Complaint Case No. 804 of 2014 registered for the offence under Sections 498(A) and 379/34 of the Indian Penal Code. The accusation is that petitioners being father-in-law, mother-in-law and brother-in-law of the complainant, Sunita Devi, in absence of her husband, made demand of Rs.1,50,000/- as dowry on 15.03.2014 and tried to kill the informant by pressing her neck. At that time, petitioner no. 1 snatched the gold chain of informant and she was ousted to matrimonial house.

No.51283 of 2014 (2) dt.07-05-2015 Learned counsel for the petitioners submits that the complainant is the wife of Pappu Singh, son of petitioner no.1 earlier on the pressure of husband of complainant, the petitioner sold the piece of land to Vinod Kumar Sah and consideration amount was given to Pappu Singh who purchased the truck. Pappu Singh again asked to execute the sale deed and on refusal this false complaint case has been instituted only to give under pressure upon the family members.

Under the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Complaint Case No. 804 of 2014, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
