JUSTICE SANJAY PRIYA ORAL ORDER 10-07-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Gopalpur (Rangra O.P.) P.S. Case No. 239 of 2016 instituted for the offence under Sections 302, 120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act.
It is alleged in the Fardbeyan that petitioner and other accused persons called the son of the informant and took him to the market. Thereafter, this petitioner along with other accused persons arrived with deadly weapons to the house of the informant and told that he had killed her son and, thereafter, fled away. Case diary has been received.
The learned A.P.P. has pointed out paragraphs-11, 14, 15 and 16 of the case diary wherein witnesses have supported the case of the prosecution. The post mortem report is available in
Patna High Court Cr.Misc. No.18488 of 2017 (4) dt.10-07-2017 2/2 paragraph-85 of the case diary wherein it is mentioned that death has been caused due to firearm injury. It is mentioned in paragraph-66 of the case diary that on the basis of CDR, the petitioner was present at the place of occurrence. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.
Prayer for anticipatory bail of the petitioner stands rejected.
Petitioner may surrender before the court below and make prayer for regular bail.
