The petitioner is apprehending his arrest in connection with Tekari (Mau OP) P.S. Case No. 3 of 2023, registered for the offence punishable under Sections 354D, 506,341, 323, 337 and 379 of the Indian Penal Code.
The allegation against the petitioner is of stalking the victim, who is a minor. The victim has alleged that petitioner has misbehaved with her, used filthy language and even threatened to kidnap the victim, while she was moving on way to coaching, and even at the coaching institute. The petitioner's defence is founded on lodging of a police case namely, Tekari PS Case No. 0 2 of 2023 for alleged offences under Section 308 and 379 of the IPC alleging that the
Patna High Court CR. MISC. No.22808 of 2023(2) dt.24-06-2023 2/2 instant case is counter blast to the said case. This Court, however, would find that Tekari PS Case No. 02 of 2023 has been lodged on the very same day.
Learned APP for the State has opposed the prayer for pre-arrest bail.
Considering the above noted rival submissions, having regard to the nature of allegations levelled by a minor against the petitioner, this Court, for the limited purposes of grant of anticipatory bail, is inclined to accept the submissions advanced by the learned APP.
Prayer for pre -arrest bail is rejected.
