Petitioner, who is in custody, seeks bail in connection with Kazi Mohamadpur (KMP) P.S. Case No. 379 of 2018 registered for the offences punishable under Sections 302, 201, 120-B and 34 of the Indian Penal Code.
Informant who is the father of the deceased Pankaj Kumar who has stated in his written complaint that his son Pankaj Kumar was employed in the Bhawani Hospital Maripur in the medicine center for last six months and had gone to hospital for duty on 28.08.2018 with his cousin brother but in the evening he was told by petitioner that he has not seen him from 11:00 A.M. and on 30.08.2018 he received information
Patna High Court Cr.Misc. No.68737 of 2018(2) dt.30-11-2018 2/2 that dead body of his son was found on the roof of the hospital and he raised suspicion against five hospital staff of killing his son but name of the petitioner is not in the FIR. However, in self-confession recorded before the police petitioner has been implicated in this case.
It has been submitted on behalf of the petitioner that he is innocent and has committed no offence. He has been falsely implicated in this case by the police. No direct or indirect allegation against petitioner. He has no criminal antecedent and he is in custody since 01.09.2018.
Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.- 1st, Muzaffarpur in connection with Kazi Mohamadpur P.S. Case No. 379 of 2018.
