The petitioner seeks bail in a case instituted under Sections 379 and 411 of the Indian Penal Code. Three mobile sets along with cash of Rs. 42,000/- and golden chain are said to have been recovered from the possession of the petitioner.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 04.08.2016. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the First Information Report. The recovered mobiles from the possession of the petitioner do not tally with the

Patna High Court Cr.Misc. No.42259 of 2016 (2) dt.03-10-2016 2/2 description made in the seizure list. There is no compliance of section 100 of the Cr.P.C.

On behalf of the state, it has been submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Rail Judicial Magistrate, Khagaria, in connection with Mansi Rail P.S. Case No. 15 of 2015, G.R. ( R ) No. 75 of 2015.
