====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 03-12-2018 Heard Sri Ajay Kumar Singh, learned counsel for the petitioner and learned Addl. Public Prosecutor. The petitioner has prayed for grant of bail in Sessions Trial No. 96 of 2013 (arising out of Adapur P.S. Case No. 60 of 2005).

The petitioner was declared absconder in the year 2013 itself, however he voluntarily did not surrender. After much belated stage, in the year 2018, the petitioner was arrested in a Excise case and from that case, he was remanded in the present case.

Learned counsel for the petitioner tried to persuade the Court that it is a case of misuse of privilege of bail. However, considering the fact that since the trial was commenced in the year 2013 and after commencement, he

Patna High Court Cr.Misc. No.70359 of 2018(2) dt.03-12-2018 2/2 remained absconder for such a long time, there is no reason to entertain the prayer for bail.

The petition stands dismissed.

Liberty is granted to the petitioner to approach the court below for early disposal of the trial.
