JUSTICE SUDHIR SINGH ORAL ORDER 06-12-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 341, 323, 326, 307, 302 and 120B of the Indian Penal Code and 27 of the Arms Act.

Allegation is that the accused persons including petitioner came and assaulted father of informant. Accused Vijay Singh fired shot upon father of informant and the deaceased died while he was brought to hospital.

It has been submitted on behalf of petitioner that he is in custody since 23.7.2016. He has got no criminal antecedent. Chargesheet has been submitted against petitioner. No allegation of tampering of witnesses is alleged against petitioner. General and omnibus allegation has been made against petitioner. No specific injury has been attributed against petitioner. The main allegation has been made against co-accused, namely, Vijay Singh, who fired upon the deceased causing death of the deceased. On behalf of the State, it is submitted that petitioner is named in the F.I.R.

No.51547 of 2016 (2) dt.06-12-2016 2/2 Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Masaurhi, Patna , in connection with Dhanarua P.S. Case no. 329 of 2016.
