JUSTICE DINESH KUMAR SINGH ORAL ORDER 08-10-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 342,370A(1),373,506,504 and 323/34 of the Indian Penal Code and sections 3 and 4 of The Protection of Children from Sexual Offences Act, 2012.
The prosecution case is that two months prior to the lodging of the case, the petitioner and her husband came to the house of the informant and requested to work in orchestra on payment of ten thousand rupees per month, consequently, the informant went to work in the orchestra of the petitioner without informing her guardians. The informant was kept for fifteen days
Patna High Court Cr.Misc. No.41667 of 2015 (2) dt.08-10-2015 2/2 at Chakia where the husband of the petitioner ravished her. It is submitted by the learned counsel for the petitioner that there is nothing on record to suggest that the informant is minor and the FIR suggests that the informant went to work in the orchestra of her own and the thrust of accusation of ravishing the informant is against the husband of the petitioner. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the fact that petitioner is lady, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge, East Champaran at Motihari in connection with Motihari Mahila P.S. Case No.13 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
