JUSTICE ARUN KUMAR ORAL ORDER 08-02-2017 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in connection with a case registered under Sections 147 and 153 of the Railway Act, 1989.

Allegation in brief is that the R.P.F. Personnel found this petitioner along with 3-5 persons standing on the railway track in the night and found that two nuts of the railway track were opened and the clip was also found broken.

It is submitted that petitioner is a vender but not registered one. Due to some dispute, R.P.F. Personnel has falsely implicated.

The allegation is serious and nuts, bolts and clip were found removed from the railway track causing gap between the

Considering the entire facts and circumstances, it is not a fit case for grant of anticipatory bail. The prayer for anticipatory bail is rejected in connection with Buxar RPF Case No.1305 of 2016 pending in the court of A.C.J.M., Railway, Ara. (Arun Kumar, J) N.H./- U T
