====================================================== CORAM: HONOURABLE MR. JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-06-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State through video conferencing.

The office has pointed out several defects but submission on behalf of the petitioner is that it is not possible for the petitioner to remove the defects in the present situation of pandemic of COVID-19 and learned counsel of the petitioner assures that he shall remove the defects within reasonable time when the court starts functioning physically. Petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-B) A, 26, 35 of the Arms Act and Sections 37(b), 37(c) of Bihar Prohibition and Excise Act, 2016.

No.20014 of 2020(2) dt.18-06-2020 2/2 Submission on behalf of the petitioner is that nothing was recovered from conscious possession of the petitioner and so far as offences of Excise Act are concerned, in medical examination, nothing was found against the petitioner which is evident from perusal of page 20 of the petition. He further submits that moreover, petitioner is languishing in jail custody since 22.02.2020.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -VII cum Special Judge, Excise, Aurangabad in connection with Aurangabad Town P.S. Case No. 86 of 2020 corresponding to G.R. No. 178 of 2020.
