The petitioners seek pre-arrest bail in connection with Kateya P.S. Case No. 100 of 2015 registered under Sections 341, 323, 324, 307 and 504/34 of the Indian Penal Code.
It is contended that there is a case and counter case
Patna High Court Cr.Misc. No.42451 of 2015 (2) dt.12-10-2015 2 / 2 and members of both sides have sustained injuries. Be that as it may, regard being had to the injuries caused to the several persons, I am not inclined to grant prearrest bail to the petitioners. Accordingly, the application filed under Section 438 Cr. P.C. is rejected.
In case the petitioners surrender and seek bail, the same shall be considered on its own merit without being prejudiced in any manner by this order.
