JUSTICE SUDHIR SINGH ORAL ORDER 08-02-2017 Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner seeks bail in a case instituted under Sections 341, 307 and 147 of the Indian Penal Code. Accusation is of causing firearm injury upon the informant by some unknown miscreants.
Earlier the bail application of the petitioner was rejected vide Annexure-1 to the present application with observation "at this stage". In the light of the said observation, this application has been preferred by the petitioner for grant of regular bail.
A report was called for from the trial Court regarding the stage of the case. It has been reported that charge
Patna High Court Cr.Misc. No.52198 of 2016 (4) dt.08-02-2017 2/2 has been framed in the present case.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 09.10.2015. The petitioner is not named in the F.I.R. His name has come in the re-statement of the informant. A suspicion has been raised against the petitioner regarding his involvement.
It has been submitted on behalf of the State that the petitioner is not named in the F.I.R.
Considering the earlier observation made in Annexure-1 to the present application and the facts of the case, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Begusarai, in connection with Ballia P.S. Case No. 262 of 2015.
