The petitioners have prayed for bail in a case instituted for the offence under Sections 323, 324, 325, 336, 307, 333, 353, 427/34 of the Indian Penal Code. As per allegation in the FIR, on getting separate information police party proceeded towards place of occurrence and a raid was conducted at the house of the petitioner from where 30 litres of illicit country made liquor has been recovered and co-accused Asha Devi was arrested from the house. At the

Patna High Court CR. MISC. No.21970 of 2023(3) dt.27-06-2023 2/3 instance of Asha Devi, several accused persons including the petitioner attacked on police personnel in which three personnel, namely, Sonu Rajak, Sudhir Kumar and Ganga Prasad received injury.

It is submitted by learned counsel for the petitioners that petitioners have been falsely implicated in this case due to high handedness of police. Witnesses have not supported the prosecution version. Infact, personnel forcibly entered into the village and started misbehaving with the ladies members then villagers protested them and a small scuffle has taken place. They have committed no offence. Only on the basis of suspicion, their names have been dragged in the present case. No specific allegation is attributed to the petitioners. Petitioners are in judicial custody since 24.01.2023.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) each with two sureties of the like amount each to the satisfaction of the learned
